police think they know the driver is but are not releasing him name br they are able to notify his family. there are no obvious signs of drinking and driving but won't be able to rule that out until toxicology tests. the p.d. is doing their part of the investigation. the coroner will arrive to remove the body. it could be another 2, 2 1/2 hours before the highway is open. right now, it is shut down starting at stouffer until a block away from her. i will send it over to traffic with mike inouye. >> for surface streets heading through the south bay, monterrey highway, tully and kurt ner, the large roadways are getting very congested. if this lasts past 6:00, it will be an issue. 880, not a problem coming down into the south bay. we will give you south bay map.

amanda knox will stand trial for the murder of her former british roommate in italy. knox and her ex-boyfriend were acquitted of murder in 2011 after being previously convicted in the death of knox's roommate in 2007. knox, who is now 25, is living in seattle. while a new trial has been ordered, italian law cannot force her to return to the country. in a statement, she says she is painful to have the ac quit tall overturned but she is confident in the truth. the supreme court is getting ready to hear the first of two cases that could change the way america deals with same-sex marriage. the first covers prop 8, the way california deals with the ban on gay marriage. frascy pots is outside the court where people have camped out for days to get one of the few seats inside. >> reporter: dozens are camped out waiting to be part of history. >> it is okay to disagree with us and about issues but we still

need to be recognized as part of the fabric of this country. >> reporter: experts say it will be hard for the court to ignore a huge shift in public opinion. 20 years ago, most of the country opposed same-sex marriage. >> the fact that majority of americans support marriage for gay and lesbian couples is going to be something that will be in the back of the justice's minds. >> reporter: two california couples are challenging the state's 2000-day voter approved ban. opponents say it violates the 14th amendment. >> we want the same sense of security that other married couples want to have. we think it is worth fighting for. >> reporter: supporters argue traditional marriage must be protected. >> the institution of marriage and marriage laws are designed to attach mothers and fathers to each other and the children they may create and raise in the best environment. >> reporter: nine states allow same-sex marriage. 38 states don't.

president obama changed his mind and told the government publicly. >> if you believe that the government should be involved in public lives, i don't see how it is contradictory. >> reporter: last night's vigil the beginning of two days of arguments that will determine how america defines marriage and for whom. of course, this is washington and what happens here at the court also affects what happens across the street at the capital. some republican insiders are already saying if the party embraces marriage equality, it could open up donations two years from now in liberal states like new york and california. from the u.s. supreme court, i'm tracie potts, nbc news. >> thank you, tracy. tomorrow, the defensive marriage act will be front and center before the supreme court. the question is, is it constitutional? congress passed a law in 1996 that blocks the federal government from recognizing same-sex marriages, defining couples past, financial and welfare benefits. our coverage of the prop 8 supreme court arguments continues throughout the morning and online.

nbc bay area.com. a follow-up to breaking news we told you about yesterday morning. the search is on for a woman believed to have kidnapped 11-month-old girl creating a state-wide amber alert. gabriella quinntara went home with her mother. the mother told police she left her in her car seat to grab something from inside the house. when she returned seconds later, the jeep was gone. five hours later, police found the girl and the abandoned jeep six miles from home. >> i want to say thank you to everybody. thank you for everything that people, pray for my baby. the police department, everything. my baby is okay, thank god. police are focusing their investigation on the suspicious woman seen walking in the neighborhood. she was walking on the court talking on her cell phone and was reportedly carrying a red and white target bag. the morgan hill preschool

teacher charged with spiking children's drinks with sleeping pills is set to appear in court. she faces 10 misdemeanor charges after a fellow teacher caught her putting a sleeping aid into toddler's sippy cups. she was arrested two weeks ago but is now free on a super advised release san jose will decide whether to give a silicon valley tech giants millions of dollars in tax incentives to keep it in town. they are considering a multimillion-dollar plan for samsung, reduce their traffic fee, utility taxes and reimburse capital expenses to keep them from moving to texas. in return, samsung would more than triple its square footage and increase its workforce by a third. san jose major, chuck read, says the tax brakes will eventually mean more tax dollars. >> we will get $25 million in additional revenues from the city of san jose in a variety of

south bay commute moves very smoothly. as we move up 880 heading through hayward, no problems in your commute in the southbound direction. live look for oakland shows you the volume of traffic. so light as it moves through the construction zones. no backups at the bay bridge toll plaza. no problems approaching that bridge along the san mateo county coastline, the devil's slide tunnels are now open. a motorcade of classic cars helped celebrate the opening during the ceremony yesterday morning. crews did some touch-up work last night and cleared out around 2:00 this morning. the tunnel replaced a treacherous stretch of highway 1 between pacifica and half moon bay. heavy rains have washed out that roadway numerous times. taking the devil out of devil's slide. >> will will be a good thing. it is 4:42. >> phil's fall guide.

welcome back. a live look from washington. looks like a sunny, clear day, not a lot of clouds. it is going to be a busy day there as the supreme court getting ready to hear the first of two cases that could change the way america deals with same-sex marriage. we will have the very latest coming up. it is 4:45. nevada lawmakers taking a gamble on a new bill to make money for the state. they are considering a bill that would legalize betting on federal elections. backers say this kind of betting is legal in london and gaming companies. they are making a fortune. the law would allow betting on senate, congressional and presidential campaigns it looks like the popular streaming service, hulu, could be up for grabs at the right price. investors looking for a littleant antacid after an up

and day on wall street. it has been a rough start for the week. that's for sure. futures are higher after the roller coaster day we had monday. the markets driven by news out of cyprus surrounding the country's bailout. it had been up by 51 points. the s&p came within a quarter point of its all-time closing high but failed to reach that. durable goods, new home prices and home sales and consumer confidence numbers. 14,447 for the dow. the knack dawnasdaq, 4245. >> hulu is looking out for possible buyers. disney and news corp own hulu and are considering what to do with their stakes in the five-year-old company. comcast gave up their stakes for buying nbc universal.

many contracts are short dw-ter. thanks so much. taking the fall. the president of the punxsutawney groundhog club's inner circle says famous groundhog, phil, correctly predicted there would be six more weeks of winter. it was relayed incorrectly because of human error. bill says he is brushing up on his ground dogese. a prosecutor who filed criminal charges against phil for fraud says he is considering dropping the charges since he came forward. >> you thought you had it bad. >> she knows exactly how important it is to us. >> we don't rely on that. >> phil had it right for the west coast. everybody is just really complaining on the east coast because they have had so much snow this winter. now, phil, you got it wrong for the west coast. you can't win any time. 4:48.

good morning to you. got a good-looking day shaping up. that's what you get for letting a furry little rodent do the weather. temperatures this morning are chilly enough for a coat. yoll need a jacket, maybe a sweater is fine in places like san francisco where we are at 48 degrees. you will probably need the coat in sonoma. 39 up there. 43 to start the day. gilroy, a pretty good-looking day. we are going to see fog through the first part of the day. numbers going to be creeping in and out when it comes to visabilities. they will be their lowest as we head through 7:00 to 9:00. overall, looking okay. if you live in the north bay, steady drizzle, specially right along the immediate coast for today. you probably are better off grabbing that umbrella keeping it handy. keep it in the car with you for the next few days. we saw that at 6:00 a.m. that's when our best chance here in the south bay comes into play. between 6:00 and 11:00 on thursday, we have our first significant showers, measurable rain. that will continue throughout the day, thursday, getting a little bit of break. friday, what's going to happen

is we get this cut-off low. really hard to dictate where those are going to end up. how much rain they are going to bring into the bay area. they mostly impact the coastline. we could pick up 3/4 of an inch if it sits out there and spins. 65 for fremont today. getting into the end of the week. here is where the changes come into play. we get that 40% chance for showers on thursday. everybody is going to see a little something on thursday. by friday, spotty, hard to dictate where those cells will come through. you want to keep that umbrella handy. saturday, sunday, our chance gets better. 40% to 70%. that means easter sunday, a little dicey. scattered rain showers a little sunny. clearing out in time for your easter brunch. back to you, laura and marla. it is 4:49. secretary of state, john kerry, met with afghanistan president, hamid karzai for the second time. today's meeting comes one day

after terry said he and karzai are now on the same page regarding international forces preparing to end combat operations in 2014. kerry is also holding a series of meetings at the american embassy today. one of those meetings is with female entrepreneurs taking part in a u.s.-backed program. some women expressed concerns that their rights would deteriorate after u.s. troops leave the country next year. kerry is also meeting with civic leaders preparing for upcoming elections. it is not all peaceful, kerry's visit to afghanistan. eight suicide bombers have attacked the police headquarters in the eastern part of the country, killing five officers and wounding another four. investigators say one attacker hit the police station and another seven stormed the compound. it is 4:50. rewards offered for nfrgs in the search for a fugitive police officer last month are being taken off the table.

the city of riverside has withdrawn its $100,000 reward offer for the arrest and conviction of ex-cop, christopher dorner. the city said the conditions were not met. dorner was found dead inside a burned-out cabin in big bear after going on a killing spree leading law enforcement on a day-long manhunt. several other groups are also withdrawing their pledges it is 4:51. one laker is promising ret trib bugs the next time he plays the warriors. with the winter olympics less than a year away, russia preparing for whatever mother nature can throw at it. what the country is doing to ensure a good winter day. a nice smooth, easy job. i can insure the traffic commute as welcoming up.

warriors. they better watch out the next time they play the lakers. howard is promising payback. he was elbowed by the warriors david lee in the second quarter. it left howard blood deed and his lip bleeding needing three stitches. lee did not get a foul. howard did for mouthing off. after the game, howard said he would remember the incident and take care of it laters athe warriors went on to win the game, 109-103. they play again in april. in college ball, sanford women play for the spot in the sweet 16. >> lady cardinals are at home at maple pavilion. tip-off is at 6:50. in the meantime, cal just secured its spot in the sweet 16. the lady bars advanced in the ncaa tournament beating south florida in overtime by 82-78. cal waits for the winner of penn state. to associate where the winter games are just 318 days away. >> but who is counting? >> we are.

russia isn't taking any chances with the weather. >> "the new york times" reporting the host of the 2014 games is actually stockpiling snow. you might remember the 10 mile temperatures in vancouver that left the host city scrambling for snow. she plans to be better prepared. 400 snow-making cannons are already shooting out snow. the city wants to stockpile 500,000 cubic meters of snow and cover it with insulated blankets to protect it from the summer heat. the hope is that half the snow will be there next year so it can be used in case russia has an unseasonably warm winter. how is that for planning ahead? >> that's quite the endeavor they have going on there. >> mike standing about i with a look at the roads out there. how is it looking? >> kind of like one of those plans i will have as the kid. i want to save the snow until next winter. we'll see how it works. we are looking over to a nice, smooth drive. moving smoothly from the live

look westbound. head lights coming off of the san mateo bridge. maps did show some slowing. maps are reports of some debris. there may have been a quick traffic break we did not see. speeds at the limit for folks coming off the san mateo bridge and dunbar ton. south bay, northbound 101. slowing approaching the area. we are going to end with a look at the bay bridge. >> 4:56. angry birds have come to life. they have found a in you home. nasa has invited the popular online game birds to roost at kennedy space center fort next year and a half as part of an effort to spark kids interest in matte and science. the angry birds space encounter features seven interactive exhibits including one where you can create your own customized angry bird. the exhibit opened a couple of days ago and it is included in regular admission to the space center. that's going popular.

"today in the bay's" bob redell joins us live near the scene at monterrey and tully with new details on the investigation going on there. good morning, bob. >> reporter: good morning, laura. they have three blocks roughly of southbound monterrey shut down. they could be shut down for the next couple of hours. southbound monterrey starting at stouffer to the opening of the plant shopping center which is about a block away from kurtner and tully. it is because of this fatal car accident involving a single

driver. took place around 2:00 this morning. san jose police are still out here. they are doing their part in investigation. so far, they believe this is what's happening. this driver around 2:00 this morning was speeding, lost control, went off the road. clipped two trees and sheered a light pole and ended up in the mess of the car in the bushes in front of el pollo loco which is at the plant shopping center. it was an officer who happened to be at another traffic stop who heard the crash, came here, was the first on the scene. the paramedics arrived a little bit later and declared the driver dead on arrival. he is still stuck in the car waiting for the coroner to come here to do their part of the investigation. san jose police believe they know who the driver is but they are not releasing his name, his identification, until they are able to get in touch with his family. so there you have it again. in the meantime, m
